EULA - Swect Technologies LLC

Please read these End User License Terms (this “Agreement”) carefully before installing, accessing, or using any software, application, plug-in, or tool (“Software”) developed and distributed by Swect Technologies LLC (“we”, “us”, or “our”).

By installing, using, or otherwise interacting with the Software, you acknowledge that you have read and understood this Agreement and agree to be legally bound by it. If you do not agree to these terms, you may not download, install, or use our Software.

Scope of This Agreement

This Agreement governs all software and digital tools provided by us unless a specific product is accompanied by its own terms. If separate terms exist, those shall prevail over this EULA for that particular software.

License Grant

We hereby grant you a limited, non-exclusive, non-transferable, and revocable license to download and use our Software on a personal device solely for private, non-commercial purposes, and only in compliance with this Agreement.

You may not:

Sell, rent, sublicense, distribute, or otherwise make the Software available to third parties.
Modify, adapt, translate, reverse engineer, disassemble, or attempt to extract source code.
Reproduce or copy the Software or any of its components beyond the extent permitted by law.
Develop derivative works based on our Software or use it as the basis for competing products.
Assert any ownership or intellectual property rights over the Software.

Intellectual Property Rights

All intellectual property associated with the Software — including source code, interface design, trademarks, logos, and documentation — is and remains the exclusive property of Swect Technologies LLC or its licensors. Nothing in this Agreement shall be interpreted as transferring any ownership rights to you.

Your use of the Software does not grant any rights in or to our trademarks, copyrighted materials, or proprietary technologies.

Prohibited Uses

You agree not to use the Software in any way that:

Engages in fraudulent, unauthorized, or criminal activity.
Facilitates phishing, identity theft, or digital impersonation.
Uploads or transmits illegal, obscene, abusive, or harmful content.
Involves unauthorized use of credit cards or financial data.
Disrupts the functionality, availability, or integrity of the Software.
Employs bots, scripts, or automated systems to manipulate performance.
Attempts to breach, access, or interfere with systems or networks without permission.
Violates any applicable local, national, or international laws.

Violation of any of the above may result in immediate suspension or termination of your access without prior notice.

Software Updates and Modifications

We may release updates, patches, or enhancements to the Software at our discretion. By continuing to use the Software after any such updates, you agree to accept all changes, including updates to this Agreement, unless otherwise stated.

Disclaimer of Warranties

The Software is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We make no guarantees that the Software will:

Operate without errors or interruptions;
Be free from defects, viruses, or harmful components;
Function on all devices, operating systems, or environments;
Fulfill your particular requirements or expectations.

To the fullest extent permitted under applicable law, Swect Technologies LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Your use of the Software is solely at your own risk. We are not responsible for any loss of data, hardware damage, incompatibility, or other adverse outcomes resulting from its use.

Limitation of liabilities

To the maximum extent allowed by law, Swect Technologies LLC and its affiliates, officers, employees, agents, contractors, partners, licensors, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from:

The use or inability to use the Software;
Data loss or system failure;
Unauthorized access or data breach;
Interruption or termination of service;
Any other matter related to the Software.

Indemnification

You agree to indemnify, defend, and hold harmless Swect Technologies LLC, its subsidiaries, affiliates, directors, officers, employees, contractors, licensors, and service providers from and against any and all claims, demands, liabilities, damages, losses, or expenses, including reasonable legal and attorney fees, resulting from:

Your breach of this Agreement;
Your misuse or unauthorized use of the Software;
Any third-party claims arising from your actions or content shared through the Software;
Any violation of law, regulation, or third-party rights caused by your use of the Software.

Termination

This Agreement remains in effect until terminated by either party. You may terminate this Agreement at any time by uninstalling and deleting all copies of the Software. We reserve the right to suspend or terminate this Agreement without prior notice if you breach any of its provisions.

Upon termination, you must immediately cease all use of the Software and remove it from all devices in your possession. Any provisions that by their nature should survive termination (e.g., limitations of liability, indemnification, and intellectual property clauses) shall remain in full force and effect.

Jurisdiction and Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of laws principles.

If any provision of this Agreement is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

Entire Agreement

This EULA represents the full and final agreement between you and Swect Technologies LLC concerning your use of the Software and overrides any previous agreements or understandings.
